Knowing the differences between these two early on is crucial to the process. Contrary to new buyers, the property title and mortgage deed are not one in the same. Agents use the legal term “title” to refer to the rights of ownership. This grants a person or persons exclusive use, possession, and the transfer of ownership rights for a given real estate property. A mortgage, sometimes called a “deed of trust,” pledges real property to secure a loan. This is a loan where property or real estate is used as collateral. The borrower enters into an agreement with the lender (usually a bank) wherein the borrower receives cash upfront then makes payments over a set time span until he pays back the lender in full.
